How Georgia Law Defines DUI Drugs
O.C.G.A. § 40-6-391 prohibits driving or being in actual physical control of a moving vehicle while under the influence of a drug to the extent that it is less safe to drive. This is commonly called DUI less safe. Prosecutors may use driving behavior, physical observations, statements, chemical test results, and other evidence to argue that a substance affected the driver’s ability.
The statute also addresses marijuana and controlled substances, including metabolites or derivatives, detected in blood or urine. This presence-based theory isn’t equivalent to an alcohol per se charge based on a defined blood alcohol concentration. The applicable statutory subsection and whether the person was legally entitled to use the substance require careful review.
Important distinctions in a Georgia drug DUI case include:
- Marijuana: Blood or urine tests may detect compounds or metabolites, but the charged theory determines how the results may be used.
- Prescription medication: A valid prescription doesn’t automatically resolve a DUI less safe allegation if the state claims the medication impaired the person’s driving ability.
